  • New housing estate roads unfinished causing damage

    a small housing estate now 2 years + with unfinished roads - there has been constant drainage issues and roads keep being dug up, they fill the temporary holes up with really sharp stones and my tyres have been damage numerous times now along with many other residents tyres. Im parking my car else where as much as I can but it is an inconvenience - can we claim for the tyre? can we take action the they get the work done on the drains and the roads tarmaced - I think they need to bring some experts in a they are doing the same holes over and over again and its such a great inconvenience and mess, noise and dust...... of course had we known we would not have moved there

    You need to look at what legal obligations the developer entered into. These will be what you will be seeking to enforce.

      There is nothing in writing - we were informed as soon as the final house is completed measures are taken for the roads to be finished, but they have messed up the drainage so keep digging up the road over and over all over

        Really? No covenants by the developer in the transfer deed?

          I will get copies - thank you, at the time had just been told it was due to be done - had left in hand of solicitor of course
