  • Written submissions only for an application hearing?

    Hi LB.

    I have a application hearing for relief from sanctions in just over two weeks time.

    Can anyone point me in the direction of correct CPR for making submissions to the hearing as I cannot attend?

    Trying to find out correct procedure and the time limits to do so.

    I can find no rule in the CPR that covers this point. I will be happy to be corrected by others.

    The nearest thing I can find is CPR27.9 which specifically relates to final hearings in cases allocated to the small claims track. You might apply the same procedure if you really are unable to attend. However, non-attendance at a hearing is always very risky.
