  • Neighbour in breach of restrictive covenant on title deed

    My neighbour moved in back in September 2021.

    It has come to my attention yesterday, that they are using their property to run their own foodbank.

    This is a cause for concern, because it is residential, and has caused me problems with parking.

    The main concern is the actual title deed itself.

    There is a restrictive covenant not to run a business from the premises.

    With that said, how do I go about shutting this possible foodbank down?

    The title deed says "No trade or business whatsoever shall be carried out on the property".

        The Council are looking into seeing if this said foodbank is registered.

        This is also causing us problems with parking, I am aware that I can obtain a Property Injunction as the said foodbank is causing problems with parking ie blocking access to my driveway.

        Their title deed should read the same as mine but I can pay £14.99 for a copy of their online to check.


        I do have legal expense on my buildings insurance, so will see if they can cover this if need be if it gets out of hand.
