  • Does procurator fiscal have time limits in Scotland?

    Hi All,

    I have just joined the forum and looking for a bit of advice (Scotland)

    I was charged 13 months ago for a crime i committed 14 months ago (assault to harm) The police at the time said it might not go to court and I might never hear anymore about it but the waiting id difficult as it could affect my employment.
    I have searched the internet and this forum but cannot find a definitive answer - Does the procurator fiscal have a time limit on deciding whether they will take further action?

    I would be very appreciative if someone could put my mind at ease.

      If anyone come son looking for the same info - There doesn't seem to be a time frame. I was called up after 15 months.

        Not seen this thread before, but I suspect that any time limits will relate to charging somebody, and not to when the case finally gets to court.

        So to go back to the original post, if an alleged assault happened 14 months ago, there is no problem with the actual charge being a month later. It could be many more months before the case gets to court.

        (Caveat: I'm not an expert on Scottish law. I assume it's similar to English law in this respect...)
