  • Ex employer witness summons

    An ex employer's solicitor has written me a letter saying they will be issuing a witness summons which will be served on me in the near future, as they believe I have relevant evidence to provide in relation to an employee's claim
    Is it likely they will actually issue me with a summons or could it be a scare tactic? I have not been in contact with them since I left, and things weren't left of the best terms. I don't have great recollection of what happened but I may have spoken to their insurance/risk assessment guy at the time (again can't even recall what I said) but guessing this is the only basis they could want me to provide evidence
    Thanks and appreciate any advice (based in NI, UK)

    What makes you think that we can say anything other than you should believe them?

    If you do not receive a summons then you will not need to attend court.

      It must be likely that they will want you to answer the summons. Why would they be interested in just scaring you?

        It is not clear from the Poster whether the court proceedings are in England & Wales or are in Northern Ireland.

        If the latter different rules may apply, but the important fact to understand is that a witness summons means what it says - the Witness must appear at court as a witness.

        Any witness is entitled to out of pocket expenses at set rates. What those might be in Northern Ireland I cannot say - the witness should call the court office to find out about that, if the witness summons itself does not give that information.
