  • Conflict of interest?

    So I am currently taking a solicitors firm to Court.

    A company I have a new claim against has just hired this solicitor.

    Is this conflict of interest? And how could I request that they not represent the defendant if so?

    The way to do it is to notify the solicitors that you consider that they have a conflict of interests, and to ask them to withdraw from acting for this other party.

    NB they do not necessarily have a conflict of interests simply by reason of the fact that you have previously been their client. That should certainly give cause for the question to be considered.
