  • Discretionary Trust Problems - Update

    I am not a very happy bunny.

    I had a meeting on the 18th August with the Trustees of a Discretionary Trust.

    My mum passed away 3 years ago, and has left me in a right state, I'm not able to access my own money and I'm 50 years old being treated like a child!!

    Anyway, I received an email on the 7th September from the main Trustee who is a Financial Adviser.

    He said very clearly the Trustees have agreed for my debts to be paid, and for money for a new gas boiler.

    They refused me money for a new car on the grounds I don't drive.

    I therefore asked for funds instead as well for a replacement cooker and hob, and a new composite front door.

    Its now over a week, and I've received no payment in particular to pay off my debts.

    I have reminded the Trustees on 2 occassions asking for the funds, they have ignored my emails.

    So it looks like the Trustees have broken promises they have made by not distributing the funds for the above after they said they would.

    So, where do I stand?

    Would this now be a definite Breach of Trust claim as they have promised in one hand funds to pay off debts and a new boiler, but on there other hand won't hand over the funds?

    What's the point of a Trust being in place if the Trustees agree for funds then don't pay?!
