  • Estate Agent taking to court

    I’m hoping someone might be able to help me.

    Recently my wife and I considered selling our house (joint owned) and chose a local estate agent to work with. The contract was only signed by myself and not by her as she wanted to sign only once we had had a positive mortgage meeting with our mortgage company.
    The estate agent verbally confirmed that the contract wasn’t binding until my wife visited them and signed on the dotted line. She never did this as the mortgage meeting didn’t go as planned and we notified the estate agent that we were not proceeding.

    my main question is this: is that contract legally binding if she didn’t sign it? After all we couldn’t have sold the property without both signatures.
