Is going back to a shop you've been banned from illegal?

  • Is going back to a shop you've been banned from illegal?

    If I've been banned from a shop, and I go back there and do not commit any illegal acts while I'm there, is my mere presence itself illegal? I've heard that it's trespassing but that's a civil issue, not criminal? Is that correct?

    However, I've also read that trespass with a vehicle is criminal and not civil, and obviously, if its a shop, chances are, I've driven and parked there, so that feels as if it would be illegal and criminal?

    If I go into a shop, I don't think they'd remember me age a while of being banned, but I don't want to run the risk of police at my door or getting arrested. If the only risk is shop security saying please leave, then that's different. I just don't want police at my door.

    Does anyone know what is, and what isn't, criminal in this scenario?

      I suspect what you have heard is a part digested understanding of the Criminal Justice And Public Order Act 1994 where section 61 refers to trespassers with 6 or more vehicles between them.
      The police may then order the vehicles removed etc etc

      The law is to prevent unauthorised encampments etc and I doubt you will go to the shop in a convoy anyway

        Trespass is civil until/unless aggravated in some way. Unlawful rather than illegal.
