  • Should I contact some one I've made a small claims court claim against ?

    I've submitted a claim via the small claims court and the other party failed to reply, so now a judgment has been made in my favour and the other party has been ordered money that is outstanding.

    Should I call them asking how they plan to settle this, or wait and see what they do ?

    Anyone got any advise on how is best to proceed.

    Give a while, say 28 days, for them to receive the court papers then write to them including a copy of the order and ask that they make a payment within, say, 14 days and if no payment is forthcoming then you will take further legal action at a cost to them.

    Then you contact the court bailiffs or if more than £600 then update it to the high court and get the sheriffs officers to collect. Fees are added to the debt.

    but make sure the defendant has the cash to pay

      If they are working and you know where tell them you will be applying for an attachment of earnings - they will often pay up to avoid their employer knowing about the debt....

        Thanks. I only got confirmation today, so I'll hang on and see what happens. Most contact I've had with them has been via Facebook messenger. If I don't hear anything I'll try writing to them. Thanks

          Hi,

          I've still not heard anything from them.. Are there any templates or letters I could send them via Facebook to see if they will respond to that ?

          Failing that, what is the best way to proceed ? The debt is currently just over £800 so I guess the High Court is next. But what do I need to do ?

            I would send a letter by mail, with a free certificate of posting from a post office.

            Call the high court bailiffs and ask. I believe that if they are given the judgement then they handle everything else
