  • Covid restriction case - incorrect date

    Hi

I would appreciate any help and advice here please?

I am being charged for an offence on Covid restrictions regs. I am charged with an offence on the 30th Dec 2020 but it took place on the 31st Dec 2020 (five friends around a house). The 31st is the Police witness statement. They sent me a fine that I didn't pay as the date was incorrect. They now want me to pea guilty or not guilty to the office of the 30th.

Am I correct in assuming I can plea not guilty since I am not guilty of the date of the offence?

The Charge sheet and Statement of facts both clearly say "On the 30th or Dec".

I would have to get a court date if I go not guilty.

    Thank you!

I would go and have a chat with a solicitor urgently. Does the witness statement say it was on the 30th even if the charge doesn't? I suspect the CPS can amend the date. If you go to court you stand to be fined a much higher sum based on your income plus costs of hundreds of pounds if you lose a trial.

      Witness statement states 31st.

They can amend the date but surely would have to reissue the fine.

I will reach out to a solicitor.

That is the best plan as you stand to be charged a lot lot more if you go to court
