  • Best way to set aside CCJ? Advice needed

    Hi everyone,

    I will start with the details.

    This week I received a letter saying I owe xxx amount of money for unsettled CCJ from debt collectors, which I knew nothing about.

    I have done some research, this was an unpaid Parking ticket in 2019, there is photo evidence and the ticket on the windscreen, and a sign not to park. I really do not remember there being a ticket?
    Honestly I pay all my parking tickets to avoid this exact thing.

    I found out they sent the claim and CCJ to an address I moved out almost 4 years ago, before this alleged parking offence and I didn't even have the car at the time, so it was definitely never registered to that address. I have lived in my current address since April 2020, and the letters about the CCJ were sent to the old address in April 2021 and May 2021! (I had other addressee in between as well)

    Do I have a chance to get the ccj to be set aside?
    I have stared writing my Draft Order ad Witness Statement. I have requested the claim details, so I can defend it and prove that they didn't use correct address and didn't even bother to look it up properly, because at the time everything was registered to my current address. And only after the ccj was issued, I start getting letters to my current address!

    I have filled out my N244 as well.

    But I do feel nervous about the actual ticket, which I don't think I can defend! Is this a problem? Or can I just focus on the wrong address thing? Honestly I have been up and down for 3 days now, one minute I feel like I have a decent chance, next minute I feel like I'm screwed.

    I have also thought of setting aside with consent, but would it be looked at like Credit cleansing?

    What is my best option here?
