  • Court summons for speeding and failing to ID driver yet I sent the forms back

    Hi all, I have received a court summons from Lincolnshire Police for speeding (38 in 30) and failing to identify the driver.

    I did fill in the original form accepting it was myself driving, expected to get a form back offering a fine/course/points but now have this summons.

    It asks me to make a plea online, I am happy to state guilty of the speeding offence but not the failure to ID.

    I currently have 4 points.

    What advice do you have to minimise the damage here?

        Do you have any proof at all you sent the form back? Failure to give information will carry 6 points and a hefty fine. As for what you should do, go and see a solicitor would be my strong advice. I have seen it go both ways in court. I have seen mags believe a driver has posted back the form and allow them to be dealt with by means of a fine and points (3) as per the original offence. I have also seen it NOT believed that it was posted and a failure to provide information (6 points) given. You can plead not guilty to failure to give information but there is a risk you will not be believed on the day - can you provide a witness who saw you post it? Can you prove any aspect of your case? A solicitor will go through this with you and advise. Remember if you get 6 points and have 4 you are on 10 - one more minor 3 point offence bringing you to 12 points or over and you are a "totter" and will be banned from driving.
