  • Action against solicitor

    A house was recently sold and the proceeds divided between my sister and I. However, before the sale the estate agent handling the sale assured me that my sister would pay £2000 towads the cost of cleaning the house (my sister and I do not get on and do not communicate with each other).
    After the sale I was expecting a draft invoice from the solicitor handling the transaction before the disbursement of money. If one had been sent I would have raised the issue of the £2000. But no invoice was sent and money was disbursed without my consultation or consent.
    Can I take legal action against the solicitor for the loss of £2000 or would my action be against the estate agent?

    Hi Raydona

    Have you established from the Estate Agent whether £2,000 was paid for the cleaning the house was actually paid for by your sister? Also why the solicitor hadn't sent a draft invoice (assuming he was aware of the cleaning costs? You could ask for all those details and go from there. Keep all communications in writing.

      Many thanks for the reply. I have communicated with the estate agent. He said an email had been sent to the solicitor before completion of sale in which it was stated "It has been agreed between myself and my sister that out of the final sale price that I am to be paid £2000 for my sister’s 50% payment for the house clearance and that is to be taken out before the remainder is allocated to each beneficiary". It seems for one reason or another the solicitor failed to do that. How can I now recover my £2000? Would my action be against the solicitor? If so what legal action can I take? Thanking you for your response.

        The Courts need to see that you've tried everything to resolve the matter before you turn to the Courts. So write a letter explaining the situation in detail.

        Find out how they intend to resolve the situation. This will give you more information, lets see what they have to say.
