  • A case for Libel?

    I had false allegations made against me that I had physically harmed a child.


    The allegations were subject to a section 47 investigation with social services and the police on two occasions (as the allegations were added to around 4 months later). In both investigations, the police took a stance of NFA.


    During my private proceedings for a CAO the school had to file a disclosure. Within the disclosure the school wrote "Father has a history of hitting children".


    The only allegations against me are party to a fact find in October however I feel that the school may have committed Libel under the Defamation act by suggesting that the allegations are that of a true nature.


    It is worth notice that the MATERNAL grandmother is a governor of the school in question and MATERNAL grandfather has on at least two occasions inform social services that he has connections to senior figures within the UK government & Ministry of Defence and that "He hasn't wanted to use his connections".


    Am I correct in thinking that as the school in question did not state that the abuse was alleged rather they stated that I have a history of it, this would warrant an application to the court for Libel?

    Forget it!

    Allegations, even if false, made to the police or a court are privileged, so no action you bring would be successful.
    It5 would just cost you money and stress.
