  • Small claims court - time following LBA

    Hi, I sent a LBA to an organisation in around May 2020. The claim would be in the small claims track as the amount is just under 10k. I had quite a bit of correspondence with the organisation up until around August 2020. I’ve since been ignored.

    Am I ok to go ahead with the claim or is there a time limit on the LBA? If so I imagine I’d be ok to send a further LBA around the same issues?

    No need to resend, but would not be to your disadvantage to resend, requesting response within a shortened time scale, say 7 days as they are already aware of the matter

      Thanks DES8, I did exactly that a few weeks ago including the old LBA and they’ve ignored. Good that I’ll be ok to actually go ahead with the claim (life got in the way!).

        Be aware of the various protocols e.g. Protocol for debt claims.
