  • Trustees Not Complying

    So my solicitors have been writing to the Trustees of a Discretionary Trust since end of February this year, repeatedly asking for an up to date copy of the Trust Accounts, and requesting for them to buy me a pension annuity as my late mother wanted me to have a monthly income.

    So far, the Trustees have NOT complied for the Trust Accounts and have failed to purchase a pensions annuity, breaking my mother's will, and letter of wishes.

    I'm currently under a No Win No Fee arrangement with a solicitor, but I wanted some advice from here.

    I have read through the Will/Trust document, and it remains silent on the removal of a trustee.

    What I want to know is, as a main beneficiary of the Trust, can I request, on the grounds of legal costs, for the Trustees to be removed from the Trust as they have failed to follow the terms of the Will Trust, failed to financially provide for me, repeatedly refuse to pay me my entitlement from my mother's estate, and have failed repeatedly to give the Trust Accounts!?

    My concern is that they have done something wrong with my money, hence why after 2 years since my mother passed away, why I've had NO payment from the Trust.
