    Hi all, here is an interesting case I'd be grateful for feedback on.

    Private family land in a Commonwealth country was appropriated by the British when they ruled that country. At the time of independence (some 70 years ago) the said land was transferred to the new countries government and is currently managed by it's military estate. Most of the land sits vacant.

    The countries legal system is largely based on British law. The rightful heirs of the land have full documentry evidence going all the way back to the time of British rule that the land is theirs. Local revenue records corroborate this.

    The heirs took up the case at every level in their home country. However, when the suit reached the Supreme Court it was time barred (Limitation Act 1908) . Can the a grieved heirs (Citizens of the ex British colony) take their case to the Supreme Court of the UK?

    Is there any legal perspective that comes to mind that the heirs can take in to consideration whilst trying to work out a way to get their land back?

      The Judicial Committee of the Privy Council is the highest court of appeal for many Commonwealth countries, as well as the United Kingdom’s overseas territories, crown dependencies, and military sovereign base areas.
