  • Does the prevalence of remote hearings for companies make settlement less likely?

    Curious about this. As Defendant companies do not now have to travel to a Claimant's home Court, per Covid, and so do not have to hire counsel to represent them there, are they more likely to battle it out/less likely to look to settle.

    Also curious if they are probably still likely to hire local counsel anyway, or a local barrister, for whatever reason (local personnel being on first name terms with a Judge, or the companies own staff not being suitably knowledgeable to act as their own counsel).

    Anyone have an opinion?
