    Hello,
    My friend is in jail on remand still after 120 days and his court case has been moved back until September! it was supposed to be this month.
    Basically he was trying to harm himself with a knife and his fiancé tried to pull the knife from him and during the tussle the knife caught her leg causing a small cut. He put a plaster on it and nothing else was said.. moving forward 2 months he had a argument with this girl and she moved out of his place and out of spite she called the police and told them he stabbed her that night along with other things like pushed her e.t.c and the police went to her house and took a statement.
    A few days later the police turn up to arrest him and he ends up in jail on remand until the case is put in front of a judge. His fiancé then decides she misses him and she cant live without him so she goes to the police to tell them it was a lie. The police said there is no official statement to retract only hearsay evidence of the body cam footage from when they went to her house.
    She then wrote a letter to the court and the CPS to tell them it was a lie , they don't respond. My friend has put 2 bail applications in which have both been denied he has 1 left.
    She has then gone to the police station to give a statement saying it was a lie. He has still not been released even on bail! She is going to turn up to court to help him and say in front of a judge It wasa accident. His solicitor said the only evidence is a photo of a small cut and the bodycam footage but she never officially signed any statement !

    Will this stand up in court?
    Why is he still on remand?
    Why have they not dropped it when she is doing all she can to tell the truth?
    Can they use the body cam footage of her without her permission?

    Surely they cant prosecute him on the evidence and her willingness to tell the truth.
    It never happened and the only witness "her" is standing in court WITH him

    Any help would be appreciated , Thanks

    Yikes - this is not ideal, really sorry to hear this. We don't cover criminal law but I have a relation working in this area so am somewhat familiar. Basically the reason he is still there - is Covid19 - the courts are running on a skeleton framework with only the most urgent hearings going ahead. The courts are unlikely to make time to consider varying bail conditions. His final trial will be similarly delayed.*
    The problem is that, even though the fiancé is doing the right thing by telling the truth now, her earlier lies could well bite her hard because she could be accused of wasting police time or perverting the course of justice. These can carry custodial sentences too. Although....I am also aware that police are increasingly pursuing convictions without the support of the 'victim' to desperately try to improve their domestic violence records, they are well used to partners withdrawing complaints, it is one of the more challenging areas of these situations.

      The problem with DV cases is that the injured party trying to withdraw the case is exceedingly common (probably every other case), even in cases where it is a clearly genuine case of violence. When you're sitting in court and trying to determine what is correct or not regarding whether to bail or not, it's not an always easy decision to make.

      What has he been charged with ? For bail to have been refused they must have had concerns.
