  • Settle a copyright infringement

    One of my taken photographs has ended up in a magazine that has a print of about 500 000 copies. It's distributed by a US government service.

    The photograph has been used without my permission and without any mention of the source (i.e. Me). The responsible publisher has acknowledged his/her mistake and has asked me to suggest a compensation.

    I'm not a US citizen and I have no idea what might be an adequate compensation, or how I should proceed with this issue.

    Could someone point me in the right direction or does somone have an idea of what one might ask for?

    The photo is about 3" tall and 5" wide.

    I have not, personally, come across any US copyright cases before, but I did some research on it for you. Please see the following,

    I believe The United States Copyright Office will be able to provide you with further guidance on this matter - https://www.copyright.gov/. You may be in good hands if you contact the UK office.

    For your issue, you may want to have a look at https://www.copyright.gov/title17/92chap5.html which is on infringement of copyright. It will provide you with the legal terms and legislation, and you may be able to get some ideas on how to put your case forward.
