  • Secretly recorded conversation - must I give them a copy if they request it?

    We started having problems with some work that a tradesman did at our house, so started to secretly record the audio of his visits. My understanding is that it is legal to do this - record a conversation for the purposes of household business.

    Am I required to give him a copy of the recordings if he asks for them? In case it matters, on one of his visits, he brought along someone to help him with the work. Does this third person also need to authorise me to share the audio recording with the tradesman?

    (I say 'tradesman', but our contract was with a limited company.)

    We are in dispute and likely will go to ADR.

    If, in legal proceedings, a document is mentioned in a statement of case, the opposing party, or parties, are entitled to inspect the document, and subject to paying the reasonable costs of copying, a copy of it.

    A video recording is a document.

    Are you entitled to record? With few exceptions, the answer is yes. Do you need the permission of the subject(s) of the recording? Again, with few exceptions, the answer is no. None of the exceptions apply here.
