I have a strange one that nobody seems to know the answer to. My son was investigated in a financial matter. Whilst under investigation all his assets were put under poca restraint for 4 years until finally after putting our family through hell they conceded there was zero evidence of any criminality. However, on the first day they came and took one car and although they restrained a second car they left it where it was parked on the street around the corner. They took the keys and all paperwork relating to it and never came back to collect it. During the following months it ran out of road tax and the local council eventually took it away and sold it. Surely now that the restraint order has been taken off the police should be liable for the value of the car at the time it was restrained for failing to remove it and putting it somewhere safe and allowing it to just be towed away. Does anyone know if we would have any recourse on this against the police? Many thanks

You sue the police for the return of the vehicle and if it cannot produce it, the value of it on the day it was seized, plus interest on that value from the date it was seized.
