Hello everyone,
I am trying to obtain my late fathers records from council commissioned care providers but they are refusing, despite they willingly gave me parts of his personal file both before and after his death. I want my fathers full file as he had been badly neglected by his carers but the council who commissioned the care have told me there's nothing they can do about it if the care providers won't agree to share the information with me.
For the past 2 months I've been trying and now my advocate is coming across the same scenario except the care providers have just got a solicitor to act on their behalf.
My advocate believes the file is not the property of the care providers as it is only being held by them on behalf of the council.
The ICO advised we sent a FOIA request to both the care providers & the council. The care providers say they are not a public authority and the council are questioning my entitlement to any information.
Ive had ongoing complaints with the care providers since 2018 and the council since February 2019.
I don't understand the law but I fully understand both are doing their best to prevent me getting the requested information.
This playground stuff is doing my head in!
