  • Forcing a House Sale

    Hi,

    I am named on the land register for a property in which I have a declaration of trust. I am not the registered owner but am named in this trust and have 50/50 shares in the property.

    Can I force the sale.

    The property was bought with my now ex partner and she is refusing to do anything, and is denying me access to my investment within the property, which I now just want sold, or as an alternative I have asked her if she wishes to buy me out, but again she is just ignoring any communications.

    Any help much appreciated.

    Hi,

    As far my knowledge goes, you could apply for a court order to force the sale of the property. I would very likely say if your ex partner will not buy you out then there is no other choice but to sell the house via a court order. As long as there is no exceptional circumstances like children etc then I cant see why it would not be granted.

      Thanks, much appreciated I will start the ball rolling as long as there won't be any issue with me not actually named as the owner. I am only on the declaration of trust. I guess I can but try.
