  • Disclosure Statement - Who Can Sign

    Is an insurance company (not being sued) under subrogation (we are assuming implicitly) permitted to sign a N265 Disclosure Statement on behalf of a defendant (individual in this case)? Defendant in reality is not going to cooperate. Would be grateful if there is any case law you might know of. I am searching for it.

    Has the insurance company been joined to the action?
    What exactly was the wording of the court order?
    Was it made under CPR 31.17 "Orders for disclosure against a person not a party" ?
