There is a court order in place for my two young primary school age children relating to time spent with each parent and travel arrangements between the two homes which are about 2 hours apart from each other. The reason for the distance between us is that the relationship was difficult and I had no choice other that to move for support and work. In the current court order my obligation is to drive half way for the pick up of the children after contact which I have been doing successfully. The court order also has a clause about if one parent moves house then to recalculate my pick up point by consent of us both. The relationship between me and my ex isn’t good and he can be quite threatening towards me and I’ve had a message from him quoting the court order and saying that as he’s moved house, which he did nearly a year ago and further away from the children, plus there was no reason for his move, in other words he didn’t have to move further away, that he now wants me to travel further for the pick up. I’ve refused this request and said that I will continue to pick up from the usual place. His reply is that he’s asked me to confirm that I’m not complying with the court order and if so things will escalate. I’m living on my nerves constantly with the threats, I had one the week before saying he is reducing my maintenance payments this month. Can he take me back to court over the travel and where do I stand with this? I’d be very grateful for some advice.
