  • I lost my child's passport; will I be in breach of the Court Order?

    I am kindly asking for help with my situation:

    The father of my son managed to obtain an Interim Court Order and wish to take our son on holiday this May half term.
    The Court has ordered me to make the passport available to the father.

    Unfortunately I cannot find it and I feel very stressed about this situation.
    Ive been trying to call Women’s Aid but unsuccessful.

    What can I do to prevent a breach of the Order?

      ...If that was that easy. By the time I get the replacement it will be outside the court order term.

        So what prompted the interim order for the father to take your child on holiday, did you refuse? It might be best coming clean on this rather sit on it.

          If, as you say, you cannot find the child's passport, and if you have made NO effort to obtain a replacement, then it is almost certain that the court will find that you are deliberately attempting to frustrate the purpose of the Order, will find you in breach of the Order, and you may very well be on the receiving end of a finding that you are in contempt of the court, a finding that might very well result in your incarceration.

          To avoid that unhappy outcome, may I respectfully suggest that you make an urgent application for that replacement passport.

                Once I got some tickets to the airplane to Italy from my parents. They said that I am working too much and need to take a rest. I could find my passport so I made another one. To replace a lost or stolen passport, you must submit Form DS-11 in person. You may be eligible to make an appointment to apply in person at a passport agency or center to replace your passport. To go to a passport agency or center, you must be traveling internationally in the next 72 hours (or 3 business days). Also, to renew the passport you need to know what form to get a passport you need to complete.
