  • Contested Non Mol & Occupation Order

    Friends spouse maliciously had him arrested claiming coercive/controlling behaviour. Police decided NFA, so wife obtained a Non Mol/Occupation Order ex parte by lying through her teeth. Friend has been using solicitor to contest order without hardly any progress, and has already spent thousands. Can no longer afford solicitors fees and is having to go it alone. There is going to be a pre trial hearing soon and each party has to send to the court the questions they want to ask of each other at the final hearing. What sort of questions would be allowed or would likely be disallowed. Are there any example questions? Also Friend has petitioned online for divorce, and has just realised that he ticked a box in error re wanting the court to decide on the financial settlement issue. He bought the house mortgage free prior to marriage (which he is not allowed to live in under the terms of the non-mol) but made the mistake to putting it in joint names. He doesnt really want the court to decide reany financial settlement, but is unable to make any contact with wife because of non-mol. Is there any way that he can vary/amend the divorce petition that he submitted?
