Ex won't let me off the mortgage

If an order to sell can not be obtained due to a child living in the home. Is there anyway I can get off the mortgage to obtain a new one as it would be 10 years to wait for an order to sell. Can the courts force the person to remortgage and remove me or am I stuck?
