  • Holiday Abroad

Hi, does anyone know, if either parent can take their children on holiday abroad without the other parents consent for up to 28 days or if the other parents consent is always required?
And in particular if that goes both ways, or if the mum can take them without consent and dad only with consent? I've generally read that consent is required, but then I also read its not for up to 28 days. Any help would be great thanks.

In a word 'No'. That goes for each parent. Abroad here means outside the jurisdiction. So if a child is habitually resident in England, the child cannot be taken, for example, to Northern Ireland. If a child is taken abroad, it would be wise to have the written permission of the other parent, so as to avoid problems with the authorities in the destination country.

You can take a child abroad for 28 days without getting permission if a child arrangement order says the child must live with you, unless a court order says you can’t.
