Re: joint names on businesses but cant get a divorce

LOL, I knew that last post would be from you cleverclogs, see i am getting to know already who sends what
The bills she was getting were from the taxman apparently, she thought he must have just put the businesses in her name, she didnt sign anything
The tax credits were according to the letter she opened because he must have told them he was only earning £5000 a year, hes a very dodgy character, from what i have heard from other people,
He must own some flats, because he has just let his eldest son have one rent free
I will look on the website you mentioned amethyst, thanks

Re: joint names on businesses but cant get a divorce

Only registered companies show up on the Companies House site, as I said earlier only one company shows on the credit search site that I use. This suggests to me that he is operating as a 'sole trader', which means he is non-limited.
I think that if you go on the land registry site you may be able to put in addresses and get the owners name, but as to how its done I have no idea.
Re declaring low earnings, its quite a common practice, then company directors take out whats known as diividends, that way our personal tax bill is zero, but it goes through the Corporation Tax, its legal and cheaper than Income Tax. Although I've never heard of anyone claiming Tax Credits or benefits whilst doing it, this guy is seriously taking the pish and needs to be reported to the HMRC.

Re: joint names on businesses but cant get a divorce

Found out a bit more about the situation now,the ex has been ordered by the court to sell all properties before they can get divorced,so he is putting them up for sale so he can say he is trying to sell, but always finds a way of blocking the sale, not that anything is selling quickly anyway, but he might be stalling because he doesnt want her to have half the money from any assets
I think the bankruptcy idea might be best, but as i said its complicated,

Also because he doesnt always pay the mortgage, the bank get onto her to pay it because she is joint owner, but she doesnt have the money to pay it, so is always living with the threat of reposession hanging over her

Bankrupcy might just be the best option if she has and registred interest in anything he owns it will all be brought into the open if this guy as one would expect be be a complete and utter he will get all he deserves and she will be able to start a new life .
Thats purely my opinon for what its worth just hope for her sake its gets sorted sooner than later

Sounds to me like he's a slippery bugger. Ok so your friend needs to write down EVERYTHING she can remember from whilst she was still with him ie:
Addresses of all properties he has, Bank Accounts and any other assets that he may have, ie cars, boats, offshore accounts and so on.

Next she needs to gather as much evidence as possible of the debts that she's been chased for that he's stuffed her for, she needs to keep any and all paperwork in a file and keep it up to date, a ring binder from the 99p shop will do the trick plus a pad and pen.

Tell her to make notes of anything that happens, phone calls, visits etc from people wanting money.

Also she wants paper copies of every alleged agreement that she has allegedly signed, no matter how small or large the debt may be, she'll probably need to write to each one making the request, so stamps will be needed too and envelopes.

She needs to get her benefits sorted out, someone else on here may be able to help with that, although proving that she's skint and not owing properties, accounts etc will be hard but worth fighting for, thats why she needs to report him for fraud at the same time and she should tell the Social Security (or whatever they call themselves now) too, the will get an investigation under way.

Then the big one, she needs a good solicitor, you can either find one on the internet or by recommendation, when she's on benefits she'll hopefully be entitled to legal aid.

No sure about the next bit, I think she may be able to get the Child Support Agency involved also.

Thats about it for the moment I think, if you need help with letters, give a shout, one of us on here will give a hand.

Re: joint names on businesses but cant get a divorce

With regard to the solicitor who is sitting on their gluteus maximus, doing nothing and charging the national debt of a small country, I would recommend that this be reported to the Solicitors Regulation Authority (SRA). Go to SRA | Protecting consumers, regulating solicitors | Solicitors Regulation Authority

UPDATE; My friend had a shock when she called in at the solicitors to ask for her decree nisi, the receptionist said dont you want your absolute ,? She said i cant have it, i was told until all the financial side has been settled, the receptionist told her to go to the court and for £45 she could have it straight away, she went immediately and they handed it over to her there and then
So what the HELL has her solicitor been doing all this time, that is costing her £15000,
She now needs advice on what to do next
I think she should report him for giving her bad advice and racking the bill up ,all for nothing it seems

See my earlier post. Report this solicitor to the SRA. This has the hallmarks of professional misconduct on the part of the solicitor. The bill needs to be scrutinised also. This is called "taxing" the bill. I am attaching a complaint form for the SRA to this post.

Re: joint names on businesses but cant get a divorce

Thank you i will pass this on, i had this firm of solicitors for my divorce, and i had to go to another solicitor to discover that i was legally entitled to stay in the marital home until my youngest children were 16, but by then it was too late, i had already moved out, and the solicitor didnt even agree that i could have any furniture,as i was living in a furnished house, but had just been offered a council house, i got nothing,so when my friend told me which solicitor she had got, i was very sceptical about what he was doing for her
