I have very recently decided to seperate from my wife. Things are not that amicable at the mo. We bought our 2nd home 23 years ago on a pay the interest and small amount of capital type mortgage that ws quite fashionable at the time. 5 years ago a relative of hers died leaving her a large sum of mone - enough to pay off the capital. Now she is saying that if I'm leaving her then I'm not entitled to anything from the house (if we were to sell it) as she paid the major share and is therefore entitled to it back and would leave me with no financial claim. Is this correct?

So you are married and contemplating divorce. How the assets are divided depends on the circumstances of you and your wife overall. There isn't a simple rule of law of the type that is being suggested to you. You need to get advice from a family law solicitor who can review your whole financial and family circumstances.All opinions expressed are based on my personal experience. thanks, I dont know who she got her info from but it was suggested to her that she would get more financial gain than I would - even when i paid the mortgage when she was a stay at home mum - just because of the inheritance that paid off the rest of the mortgage.
