  • Prohibited Steps Order

    I have applied for a Emrgency Prohibited Steps Order against my ex partner, my son’s mother.

    My sons mother is from South East Asia and we have been together for 7 years, during the time I have provided everything financially whilst her and my sons mother were living in Asia, I visited multiple times a year and as my son got to 5 years of age we decided to live life in England, I applied for a British passport for my son and for a unmarried partner visa for my sons mother, we have lived here for 15 months and I have helped her create a CV and apply for work. She got accepted for work on month 13 and once she received the job she changed, she stated she didn’t want to be in a relationship with me anymore and wanted to take our son back to Asia, I explained I couldn’t allow that to happen but that we could separate and she apply for a parental visa instead. However she decided to contact the police and Social Services and say I have been controlling her financially, stopping her speaking with friends and family and have been harmful to our son. All of which are false and she has no evidence to substantiate her claims. She has stolen £2100 from me and about £3000 worth of gold belonging to our son and other electronics belonging to our son and I have evidence of her saying if I don’t do what she says she will kill herself and our son and other evidence showing she has said multiple times she will take him away from me to Asia and he will never see me again.

    She is now living separately to myself and our child and has not made any effort to see him.

    I have put an application in place for a Prohibited Steps Order to stop her doing this but she is now making claims to Social Services that my son is malnourished, staying awake all night playing video games and isn’t being well taken care of.

    I have a hearing coming up in which I need to represent myself for the best interests of our child and am hoping to seek some advice please.

      Haver you got a court date yet?
      In a circumstance like this, you need to prepare carefully. It may be wise to PDF examples of behaviour (texts/emails) which you can submit to the court ahead of your hearing.
      The courts take a very neutral view and will expect you to try to co-parent with your ex-partner and do what's best for your son. You need to be careful that your ex's precarious work/visa situation is not seen as unecessary pressure on her and you should research 'leave to remove from jurisdiction' to understand her potential rights to leave the country.
      Her absence from your son's life must be documented, put together a clearer calendar of contact and what has happened. Start keeping a diary.

        Thank you for the response, I have a court date for the 10th September. I have began documenting evidence and writing a statement. Ideally I would have preferred not to have to do this and co parent with my ex partner but right now it doesn’t seem possible as she tries to turn our son against me and I feel with her threats to kill herself and our child that I offered family members to supervise any contact but she has refused so far to have any contact with our son because of someone else being there. This is another concern because she has made claims on video calls with him that once they are together she will take him away. I will research the ‘Leave to Remove from Jurisdiction. Thank you.
