  • Child support payments (Scotland) - legal position when children go to University

    Morning

I have been separated from my husband for approx 3 years, we have a legal separation agreement in place where he provides £1000 per month towards upkeep of our 2 children (age 17 and 19 currently).

One is in first year University (in Scotland) and the other will start in September this year. He is threatening to stop payments as both have finished High School. My separation agreement makes no reference to further education.

Can I have some advice on my rights for him to support his children financially through further education please? As mentioned, domiciled in Scotland as there is sometimes variances in Scottish law.

I'm happy to go through the CSA if that makes a difference but like so many Mums, I'd prefer not to.
