The situation is that I have been separated from my wife for a year but we have not yet started divorce proceedings. When we met, she had owned a mortgage free property for 6 years. I moved into her property for 6 months before buying my own property (in my name only) in May 2019. We then moved into my property and rented out her property, which has continued to be occupied. We co-habited in my property until we got married in August 2021.I managed and paid all mortgage and bills for my house while she looked after the tenants in her house and paid for food and extras for us. We separated in March 2024, at which point, my house was already on the market. This has now been sold and I have had an offer accepted on another property.
As mentioned, we have not yet started divorce proceedings but she has asked me for 50% of the equity in my property at the point of sale (which will be pre-divorce). She has also said that I have no legal claim over her property as she owned it before we met, these two factors would essentially mean I was unable to move. My position is that I feel I should be eligible for something from her property for equity gained in the period we were financially connected (I absolutely would not want to claim anything from the period before our finances were joined). I also would like to know if it would be unwise to share any equity now as I worry she will have this and then still have a claim over half of my new property so could do with some clarification over how strong a case I would have please.
