  • Query re financial order mention of child maintenance

    My partner and I need to revise the child maintenance he is paying down this September, as one of his kids is going to uni.

    His financial order with the ex states the below, are there any solicitors on here to help please? We are presuming he can just revise it down in September as there will be one less child to pay for (and he will need to pay his child direct at Uni), or is there something else he will need to do to revise it down? We are presuming that the below only applies for a year and that he is free to revise the amount down from £700 a month from September, is our understanding correct?

    Declaration of intention not to apply to the CMS
    The applicant will make payment towards child maintenance at the rate of £700 per month.

    Although the parties accept that the jurisdiction of the CMS cannot be excluded for more than one year, neither party has any intention of applying to the CMS for a CMS calculation.
