  • Getting divorced, I have a Home Rights Notice, Wife has changed locks. Help please

    Hello

My Wife has decided to separate and file for divorce, She has sold our house without my consent as her name is solely on the mortgage but i have Matrimonial Home Rights. She has tried to get me to remove this Home Right Notice which i have not accepted as we still as yet have not finalised our finances etc. Because i have refused to remove this notice its stopping the sale of our house from going through so she had me arrested for Theft and Harassment i suspect on the basis of me being charged which i am led to believe should that of been the case the Home Right Notice falls apart and then the house sale can still go through etc. I was placed on bail for 3 months and couldn't go home or near the house, the Police threw the charges out as they were fabricated and subsequently lacked evidence.

I went home on the 3rd week (Took 3 weeks to be acquitted) to find all the locks to the house have been changed? My belongings and furniture and our dog are all in the house. Thankfully we have no young kids they moved out some time ago and are in the 20's and 30's now. I was advised of applying for a Occupation Order which i did and then in retaliation my Wife filed for a NON MOL she told me she done this in retaliation. We went to court 4 weeks ago and the Judge pretty much advised my wife and I to withdraw the applications as it would be May 2025 before a 2nd hearing in Court. (I cant wait that long) but also the Judge said to me to withdraw my Occupation order and she will allow me access with times to enter the house for possessions and to see our dog. We both withdrew, i thought i was being granted times by court, i have received a letter this morning from court saying i need to write and agree times with my wife to see our dog, in our home. This is not what i was led to believe. Maybe i should of used legal representation but i simply cannot afford this as yet all my funds are tied up in our home.

What other legal way can i have access to our home? how can she change locks legally while i have a home rights notice? the mind boggles...

any help is very much appreciated thank you.
