  • Divorce invalid marriage?

    My mother was married in Ireland 1974 and left Ireland in 1990 to go to the UK but never divorced. She got married in 2002 UK and is now going through a divorce .

    Going back to my mothers Irish marriage, The judge in Ireland (or clerk) did not sign the paperwork that would have made the divorce final. So in all the years since pre 2002 my mother and father considered themselves divorced.

    My mother needs to know that if her original marriage was still active in the eyes of the law in Ireland that surely means her 2002 marriage is not legal and should be void?

    She has all relevant documents and solicitor correspondence with dates of original marriage etc to produce. This is all a result her current (void) UK marriage is ending and he is trying to claim property value or money. Somebody please clarify if this is correct her UK marriage is invalid and void.

    I think your mother has a serious problem. She should take legal advice from a family law specialist solicitor.

      To bring certainty into this I suggest that your mother applies for a certificate of divorce

      If that certificate does not exist, then the parties remain married to each other in both Irish and English law.
