  • Fraud? Ex husband

Looking for some advice if possible

i left my husband in 2019, in hindsight I shouldn’t have left family home but because of who he is I did.
when I left he was remortgaging and we went to solicitors to take my name off mortgage and unbeknown to me at time, he also took me off deeds at land registry. I must of signed something at the time but have no evidence of this.
currently going through an acrimonious court battle with him agreeing out of court and 7 months later changing his mind and taking me back to court.
FRAUD issue is going through forms he submitted I read through the transfer of equity forms he filed out he has lied on them saying we weren’t separated or going through a divorce. Since doing this is has been able to remortgage the property twice and leave very little equity in property. He’s put all the money in his own personal account so I can’t access it and on the forms it clearly says the mortgage company would not allow him to release money without a court order. However because he lied on forms so he’s been able to TWICE!
can anyone advise me on what to do as this man is dragging me through the court system. I’ve had to obtain legal aid to help me but they are totally uninterested in this issue and as far as I can see, he’s broken the law.
    thanks so much in advance

Ok, this is not my specialist area, but I hope these thoughts help.

I suggest that you take time to think what you really want to get out of this. Is it the best possible financial and property settlement? Because if that is what you really want, your solicitors may be right - there may be other ways of getting at the value he has extracted from the property.

I have often had to spend time with clients, helping them stay focused and concentrating on their objectives, and not wasting energy and money on upsetting or annoying side tracks.

Perhaps you need to talk this through with your lawyers.

Thank you so much. yes you are right I am trying to get the best financial outcome obviously however this has been dragging on for over 4years and court dates are being set and he is cancelling them for various reasons. All the while he has access to the money from the property and has been spending it on cars his own legal fees etc. when I found this out my main thought was leverage to finally get this sorted/an end to all the stress and perhaps out of court rather than this continuing to drag on. Thanks so much for your time. My concern was my solicitors might not be interested in it because ultimately they want it to go to court as that’s how they make their money.
      kind regards
