  • Help wanted re XH forcing sale of family home with young children

Hi I m looking for some solid advice - I have just received the paperwork for a court hearing from my XH to ask the court to force the sale of the family home - we are divorced and we have 2 young children. The children and I stay in the house - he was arrested by the police over a year and half ago for control and coercion and never returned. It scares me that he has no regard for the childrens welfare - I have put proposals to him around sharing the costs for the house and letting the kids and I stay here until they are older but all he cares about is getting his money out the house. Any advice would be really helpful.

Is XH seeking an order for sale under the Trusts of Land and Appointment of Trustees Act?

    Is the property jointly owned?
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

The Court will always put the welfare / interests of the children first.
