Hi guys, first time poster here. I wonder if someome could kindly help me (as Google could not lol).
Had a huge row with the better half and egged by her relatives she applied for a divorce umder the new no fault law. She is very upset and feels like she was pushed into and does not know how to cancel it.
I have tried looking into "withdraw divorce application before service," as this literally happened the other day and am i right in thinking it is just a case of her writin/emailing the court to cancel it??
I found the following:
Section 7.9 of the Family Procedure Rules (FPR 2010) SI 2010/2955, provides that an application for a matrimonial or civil partnership order may be withdrawn at any time before it has been served by giving notice in writing to the court where the proceedings were started.
Is the above now out of date or still valid?
Please I would be very grateful if I could get someone's view on this?
Many thanks in advance
