  • "Without Prejudice"

    I am in the middle of a divorce, and am acting in person. My wife writes "without prejudice" on pretty much everything she sends to me. I want to use some of these communications in evidence, since they do not qualify for the privilege which is given to genuine Without Prejudice communications (ie genuine attempts to settle). My question is: how do I get the court to acknowledge before the next hearing, that the privilege is not available to these communications, so that I can cite them in court during the hearing.

    I hope that you have managed to move forward with this matter.

    As you say you are acting for yourself in the divorce, have you discussed with your wife the financial settlement you propose? Without a financial settlement that the Judge can agree, the divorce will not go through and you may well feel that legal representation would be best.

    As for the letters marked 'Without Prejudice', your wife may well have been advised to add his to all her letters. It is a simple way to ensure that nothing said can be upheld.
