  • Ex obstructing viewings when order for sale in place

    Hello there.

    I have parted ways with my ex. The divorce is done and all that is remaining is to sell the flat.

    There is a financial order including and order for sale included within that which was issued last year.

    Things have been very slow real estate-wise in our area due to the pandemic but things are slowly starting to pick up.

    I am no longer living in the property. My ex is. I am continuing to pay all of my obligations in terms of mortgage, etc., each month.

    The issue I have is that my ex is not looking after the property. We struggle to get second viewings and when we do get them the flat is not in a good state seemingly.

    I know I can move back in, but am frankly quite scared to due to abuse issues.

    I have a lawyer in place but I feel like my options are limited. 'We can't get a judge to tell him to clean up the flat'... is the advice. But this has been going on for well over a year and doesn't seem right. I am stuck in limbo it seems with a financial order including the order for sale that is only as useful as my ex permits it to be. I feel I have no power in this.

    Is there anything that anyone can suggest I do?
