I was awarded a lump sum in a court order in 1996. My ex wife was to pay me £2,500 upon the sale of her house but she had the right not to sell immediately and to live there until she died. She has just died, 25 years later. The house at the time the court order was made was worth £40,000 but has just been sold for £350,000. My calculation from those figures is that the £2,500 today would be worth £21,875. Do I have any chance of increasing the lump sum from the £2,500 seeing that it is now very devalued after 25 years? The court order did not mention interest at all, it did not say that interest should be payable but then again it did not say that there should not be a value increase either. It just says that I am not entitled to apply under section 2 of inheritance (provision for family and dependants) act 1975 S.15 save in relation to the payment of the lump sum. I would also add that the court order instructed my ex wife to execute the charge on the property herself in my favour but she never did that. Using the same court order, I placed the charge on the property myself just five years ago. A conveyancing solicitor has now contacted me requesting that the Unilateral Notice in respect of a charge is removed.
