  • Questioning a medical report

    Hi.
    I am currently exercising my parental responsibility with my 2 children based on 3 referrals to social care regarding mums mental health and having only recently been discharged from hospital for an unknown illness.

    I wrote to her solicitor asking for a doctors letters confirming she is well enough to care for the children.
    the medical report is full of “seems”, “possibles” and “maybes” and nothing firm.
    The letter says she was assessed by a mental health team via telephone less than 24 hours after only what I can describe as a extremely distressing Facebook live video where she raised several alarm bells with mutual friends and I believe one of the referrals came as a result of.

    would I look in bad light if I was to question these reports to her solicitor or in court?

    No - The issue that a court would have to decide is - Given her medical history, would it be in the children's best interests for mum to, at present, have parental responsibility?

      Thanks for your reply.
      If I was to ask the court to order a full psychiatric assessment of mum.
      What hurdles or legal processes is her solicitor likely to throw back at me?

        I couldn't possibly answer that question. However, my advice, for what it's worth, is the proceedings here should not conducted as if they are adversarial. If I was in your shoes, my position would be focused on the best interests of the children, rather than some sort of custody battle.
