Ok so mother has now agreed to transfer benefits and once this is completed then I would suggest that you apply for a variation of residence order by agreement - shouldn't cost a lot in court fees at all.

To clarify a RO means that is who the child lives with primarily, it doesn't mean that the child cannot go elsewhere to live by agreement with the RO holder. Both parents still retain PR for the child, so in this case Dad has PR anyway.
