Hi Casper, In your case was she allowed to stay in the house for that length of time and did he have to continue to pay all the mortgage, utilities and council tax as well as CSA payments?

Definitely had to pay the mortgage and CSA payments. Pretty sure he didn't pay utility bills or CT.

But he has to get the log books, if she sends them away to get her name put on them as the registared keeper, he hasn't got a leg to stand on. So the sooner the better.

That all depends if he has a Bill of Sale and/or Finance Agreement if he does that overrules the V5 as to being the owner a V5 is the registered keeper nothing more.

He needs to take professional advice. We're not professionals working in the law so please please please, whilst you take other posters experience of their own life or people they have known, a legal advice will give him his rights with regards to the house, car and maintenance issues. It would be nice to know their viewpoint but ultimately, your friend NEEDS legal advice.

I quite agree Leclerc he needs to get a solicitor that specialises in family law asap.

Thanks you so much to everyone for their advise. My brother has now been given two days compassionate leave to try and get an appointment with a solicitor to start to clear things up. Thanks again
