  • Need help blocking my sister from getting joint tenacy of my moms house

    Hello all!

I'll try and make this as short and to-the point as possible.

My mother passed away Jan 3rd of this year. My dad has administer of the estate. What he decided is he gets 50% plus 100K cash. My moms crop land was sold, and he gets cash. My sister also gets cash. I get my mom's clutter of a house (that I never wanted). It will take a year to get rid of all this stuff. It's supposed to be up to the estate, but I got stuck with it. They are taking almost 10K more than the house is apprased of (assuming that all of the stuff is gone and able to be moved in to). There was stuff packed almost all the way to the ceiling, and only had a few narrow pathways to get around in ).

Anyways, when I got the letter from my dads lawyer, I read on the side that it says my dad gets "Any survivorship property owned together with the Decedent". Mine says the legal description of my moms house, and some cash. On paper the numbers work right. HOWEVER on my sisters, it says Joint tenacy personal property as described in the inventory on file herein.".

From what I understand, she can go in my house whenever she wants. She can also sell the house withougt me even knowing! My sister has refused to talk to me for about 2 years. I told my dad about this, and he said I get the ouse, and the title is going to be in my name. My sister tried to land me in prison a while ago. She is evil. Her husband is in real estate. Both have loads of money as well as my dad. On the paperwork, it says the address is 416 Gold st. The address is 414. I don't believe this a typographical error. West side of the street is odd numbers. The east is even. So, she must have the 414 number and i got 416. Plus when I looked up the legal description via web search, the house is on an online auction site! Very first hit! She wants the house and that would make me homeless.

I need legal advice on this. I am having a hard time sleeping at night.

    Thanks in advance,

    Mike

P.S. my sister had full POA over my mom, and she sent me an eviction letter. I need to get this resolved.

Reading this, I have the impression that you may not be in the UK. Please clarify - this is a UK law discussion forum.
