  • Ex Girlfriends parents threatening small claims

    Before I split with my girlfriend, her parents offered to take us all on holiday. This included my girlfriend, her child, me, my girlfriend's sister and boyfirend and the parents.

    Now we have split up and they are demanding I pay the cost of my part of the holiday and if I dont they will pursue it through the small claims court.

    Can they do this - even though I wasnt asked to contribute in the first place?

    They can do that. Whether they will succeed is another question. At present, on the information presented, it seems unlikely.

      Given what is said here, I think it would be unlikely.

      There doesn't appear to have been an intention to create legal relations. As in, you were invited as part of the family and there doesn't appear to have been an intention for you/your girlfriend to be liable for the debt.

      However, it will depend upon any statements made between the family members that may contradict this. For example, whether the parents have asked anyone else to contribute.
